SignalArk is a business-to-business (B2B) AI-powered Go-To-Market (GTM) intelligence platform. We provide tools to aggregate, process, and analyze publicly available business signals to assist sales, marketing, and revenue teams in identifying target accounts.

2. Account Registration and Security

To use our Service, you must register for an account. You agree to provide accurate, current, and complete information and to update this information as necessary. You are strictly responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Subscription Plans and Billing

SignalArk offers free tiers and paid subscription plans. All billing, invoicing, and payment processing are securely managed via Stripe. By subscribing to a paid tier, you authorize us to charge your provided payment method on a recurring basis as outlined in your subscription plan. Fees are non-refundable except where required by law.

4. Acceptable Use

You agree not to misuse the Service. Specifically, you shall not:

• Use automated scripts, bots, or scrapers to access, copy, or extract data from our platform.
• Resell, sublicense, or distribute the data provided by SignalArk as a standalone product.
• Use the Service for any illegal, fraudulent, or malicious activities.
• Interfere with or disrupt the security or integrity of the platform.

5. Intellectual Property

The Service, including its software, AI models, algorithms, UI designs, and proprietary methodologies, is the exclusive property of SignalArk Inc. Nothing in these Terms grants you a right or license to use the SignalArk name, trademarks, or proprietary code.

6. Data Ownership

Your Data: You retain full ownership of the data (such as CRM records and contact lists) that you import into the Service.
Our Insights: SignalArk retains ownership of the analytical insights, intent scores, and compiled intelligence generated by our platform using public data and our proprietary engines.

7. API Usage Terms

If you access our Service via an API, you agree to comply with our rate limits and technical documentation. We reserve the right to revoke API access if we detect abusive, excessive, or unauthorized usage patterns.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SignalArk Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of the Service.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. SignalArk makes no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Indemnification

You agree to defend, indemnify, and hold harmless SignalArk Inc. from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your violation of these Terms or your misuse of the Service.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and without prior notice, if we reasonably believe you have violated these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.
